Eduardo S. Lombard

A firm shareholder resident in the Tallahassee office, Ed is a complex commercial litigator with extensive experience in administrative tribunals and federal and state courts. His practice is focused in three main areas: government procurement, administrative law/regulatory, and complex commercial litigation. For almost 20 years, his practice has encompassed the representation of companies transacting business with or regulated by state and local governments. With significant experience across a wide variety of industries in government procurement and regulatory matters, Ed counsels clients in all aspects of public procurement, from responses to bid solicitations to bid protests to performance of public contracts. He also regularly advises clients on regulatory issues affecting their businesses.

With experience in complex commercial litigation as well, he has handled commercial disputes throughout Florida involving contract law, business torts, and construction law.

During the first seven years of his career, he practiced complex commercial litigation at the Orlando and Miami offices of some of the country’s largest law firms. In 2005, he relocated his practice from Miami to Tallahassee to be at the heart of Florida’s state government. From Tallahassee, Ed serves clients from the Panhandle to Miami and all places in between.

Ed was born and raised Miami, Florida. He and his wife have two young daughters. He enjoys spending time with his family and is an avid FSU sports fan.

Procurement and Government Contracts

  • Represents one of the nation’s leading computer manufacturers in various public-procurement matters
  • Represented national health insurance company in multi-billion-dollar protest of Medicaid-privatization procurement by Florida’s Agency for Health Care Administration
  • Represented a Florida state agency in defense of protests regarding the procurement of multi-billion-dollar HMO insurance contracts
  • Defended contract award to telecommunications company in bid-protest proceeding by competitor for multiyear, multi-million-dollar telecom contract with one of Florida’s largest-budget agencies
  • Represented Fortune 250 companies from various industries, including IT, health care, construction, and outsourcing services, in bid-protest proceedings—both defending contract awards and challenging awards by local and state government entities

Administrative Law/Regulatory

  • Currently the lead outside counsel to the Florida Department of Health in medical-marijuana litigation, including rule challenges, challenges to licensing decisions, and constitutional challenges
  • Represented individuals and companies in a wide variety of industries in administrative proceedings against state agencies under Florida’s Administrative Procedure Act, including rule challenges, license denials, and other agency action adversely impacting business operations
  • Advises companies on maintaining compliance with state rules/regulations

Commercial Litigation

  • Represented venture-capital firm in breach-of-contract action against publicly traded banking institution
  • Represented technology company in prosecuting claims of unfair competition, breach of fiduciary duties, and conspiracy against a competitor and former management-level employees
  • Defended multinational financial institution in action for tortious interference with contract and conspiracy
  • Prosecuted Lanham Act claim for leading insurance company
  • Defended leading securities firms against customer claims for breach of contract, fraud, and securities laws violations
  • Represented litigation committee of Board of Directors of Fortune 500 company in shareholder derivative action
  • Represented investigation committee of publicly traded company regarding internal investigation of whistleblower allegations
  • Represented biotech pharmaceutical company in product licensing dispute
  • Represented Fortune 500 companies in a variety of contract and business disputes

Construction Law/Litigation

  • Routinely advises heavy civil contractors regarding compliance with FDOT rules/regulations, prequalification, joint venturing, and contract compliance
  • Represented construction contractor in prosecuting claims for delay against material suppliers and against subcontractors
  • Represented construction contractors in prosecuting claims against local governments for damages resulting from differing site conditions and defective plans
  • Represented paving subcontractor in claims for unpaid contract balance
  • Represented engineer against professional malpractice claim by project owner
  • Defended sureties on payment and performance bonds in a variety of public and private construction projects
